§ 1.
Für nachstehend genannte Gruppen von Steuerpflichtigen werden nach den jeweiligen Erfahrungen der Praxis anstelle des Werbungskostenpauschbetrages gemäß § 16 Abs. 3 EStG 1988 folgende Werbungskosten auf die Dauer des aufrechten Dienstverhältnisses festgelegt:
9. Vertreter
5% der Bemessungsgrundlage, höchstens 2 190 Euro jährlich.
Der Arbeitnehmer muss ausschließlich Vertretertätigkeit ausüben. Zur Vertretertätigkeit gehört sowohl die Tätigkeit im Außendienst als auch die für konkrete Aufträge erforderliche Tätigkeit im Innendienst. Von der Gesamtarbeitszeit muss dabei mehr als die Hälfte im Außendienst verbracht werden.
